What are the salient terms of a tenancy agreement that we as tenants, need to be aware of?

The relationship between a landlord and tenant is on a contractual basis and is regulated mainly by the tenancy agreement which will be executed by both parties. The terms of the agreement may vary depending on parties’ negotiation. That is why it is advisable for you to engage an experienced real estate professional or lawyer to assist you on this to ensure you get a fair deal and that you are fully aware of your obligations under the tenancy.

The most common terms of a tenancy would include the below.

  1. Tenant’s obligation to pay rental on time, failing which there will be late payment penalty or interest and the landlord may have the right to terminate or take back possession of the property.

  2. Tenancy tenure which is usually between fixed period of 1 to 3 years with an option to renew for another 1 to 3 years at the prevailing market rate. Two important points to note here. First, most of the tenancy agreement would not allow early termination during the fixed tenancy period and any early termination would entail forfeiture of your securities deposits as well as liability for the rental of the unexpired term. This issue may be addressed early by getting the landlord to agree to an early termination/ exit term in the event you really have to terminate the tenancy before the end of the fixed tenancy period. Second, assuming you complete the initial fixed tenancy period and would like to renew the tenancy, most tenancy agreement will provide that the renewal should be based on the “prevailing market rate”. This may open for argument as well as “abuse” by some parties and when parties are not able to agree on what the prevailing market rate is, the renewal may be an issue. So, it is advisable to put a cap on the renewal rental rate which should not exceed or less than a certain percentage of the current rental.

  3. Deposits required of the tenant. There are 2 main types of deposits required from a tenant, i.e. securities deposit and utilities deposit. The former usually ranges from an amount equivalent to 2 to 3 months rental while the latter usually ranges from 0.5 to 1 month rental. Some landlords may require other deposits like reinstatement deposit, mailbox deposit, key deposit, etc.

  4. Tenant’s duty to reinstate the premises to its original condition upon expiry of the tenancy. What amounts to “original condition” may subject to different interpretation and it is important that you check with your real estate representative and the landlord in respect of the “original condition” expected of you before you sign up for the tenancy or lease.

Apart from the monthly rental, what are the other charges I need to pay every month as a tenant?

Most of the monthly rental for properties in Malaysia would have included service charge, quit rent and assessment charges which are borne by the landlord. As such, you do not need to worry about those items. The charges which you need to bear as a tenant are your own parking fees and utilities bills which include Indah Water, electricity, water, internet and phone line charges. Always check your tenancy agreement to confirm the actual arrangement.
